Article 1 In order to strengthen the standardized management of imported mechanical and electrical products, these Measures are formulated in accordance with the "Regulations of the People's Republic of China", the "Regulations on the Implementation of the Standardization Law of the People's Republic of China" and the "Interim Measures for the Administration of the Importation of Mechanical and Electrical Products".
Article 2 All mechanical and electrical products imported into the Catalogue of Standardized Management of Imported Mechanical and Electrical Products (hereinafter referred to as the “Standard Management Catalogueâ€) must comply with the standards enforced by China. The Catalogue of Standardized Management shall be formulated by the competent department of standardization administration under the State Council in accordance with the mandatory national standards, industry standards, and standards enforced by laws and administrative regulations (hereinafter collectively referred to as mandatory standards).
Article 3 The demonstration prototypes used for participating in exhibitions, presentations, trade fairs and other similar activities are not under the management scope. If they need to be purchased or sold, they shall be managed in accordance with these Measures.
Article 4 The standardization management of imported mechanical and electrical products means that the import and export of mechanical and electrical products listed in the Catalogue of Standardized Management shall be self-inspected according to the compulsory standards, and shall be subject to the standardization administration by the relevant administrative department of the State Council or the municipal government directly under the Central Government and the municipal government. The competent department (hereinafter referred to as the management department) shall file the record and issue the activity of “Imported Mechanical and Electrical Products Standardization Management Record Certificate†(hereinafter referred to as “Standardization Management Record Certificate†and Annex 1A).
Article 5 For products listed in the Catalogue of Standardized Management, the import and export management institutions of all levels of mechanical and electrical products shall use the “Standardization Management Record Certificate†issued by the administrative department as one of the basis for handling import procedures.
Article 6 The competent department of standardization administration under the State Council shall uniformly manage the standardization management of imported mechanical and electrical products throughout the country and perform the following duties:
(1) Formulating guidelines, policies and relevant regulations for management work;
(2) Supervising and inspecting the standardization management work;
(3) guiding, coordinating and handling major issues related to management work;
(4) Uniformly printing the "Standardization Management Record Certificate".
Article 7 The relevant administrative departments of the State Council and the standardized administrative departments of the people's governments of the autonomous regions, municipalities directly under the Central Government, and the municipalities directly under the Central Government, and the standardization management of the imported mechanical and electrical products of their respective departments and regions shall perform the following duties:
(1) Implementing the guidelines and policies for standardization management, and proposing amendments to the Catalogue of Standardized Management;
(2) Responsible for managing the record-keeping work and issuing the “Standardization Management Record Certificateâ€;
(3) Dealing with relevant disputes and reporting to the standardization administrative department of the State Council in case of major problems;
(4) Providing relevant consulting services to importing units;
(5) Regularly submitting the status of the registered products and the list of import enterprises to the standardization administrative department of the State Council and the State Import and Export Office of Mechanical and Electrical Products.
Article 8 Before an importing entity declares to import or export the mechanical and electrical products listed in the Catalogue of Standardized Management to its own department or the import and export management institution of the local mechanical and electrical products, it must first report to the department or the provincial-level, plan-listed municipal standardization management department for standardization management filing.
Article 9 The standardization management of imported mechanical and electrical products shall be based on the principle of self-inspection by importing units, and the importing unit shall ensure that the imported mechanical and electrical products meet the requirements of China's mandatory standards.
Article 10 After passing the self-inspection, the importing unit submits the “Regulation Form for the Importation of Imported Mechanical and Electrical Products Standardization Management†(Annex 1B) to the administrative department, and provides the following technical materials:
(1) Self-inspection report on standardized management of imported mechanical and electrical products (Annex 1C);
(2) the original and Chinese texts of the technical or technical requirements for imported products;
(3) The product issued by the manufacturer of the product outside the country (the country) or the product issued by the state and the recognized inspection agency or certification body meets the certification materials of China's mandatory standards;
(4) Product instruction manual and product picture;
(5) Other supporting materials that need to be provided.
Article 11 The standardization management department shall, within 5 working days, conduct a formal review of the “Imported Mechanical and Electrical Products Standardization Management Filing Form†and relevant technical materials submitted by the importing unit, and accept the requirements in accordance with the requirements, and 5 jobs after acceptance. Completion of the record within the day, the issuance of the "Standardization Management Record Certificate"; for those who do not meet the requirements, will not be accepted, and explain the reasons.
Article 12 The importing unit shall be responsible for the "Imported Mechanical and Electrical Products Standardization Management Filing Form" and related technical materials provided by it, and shall not provide false self-inspection reports and technical materials; shall not forge, fraudulently use, alter or transfer "standardized management" Filing certificate.
Article 13 If the standardization management is not filed in accordance with these Measures, the import and export institutions of mechanical and electrical products at all levels shall not handle the import formalities.
Article 14 The standardization administrative department that performs the duties of import and export of mechanical and electrical products shall be responsible for the supervision and inspection of standardization management, and penalize the illegal acts: For the provision of false "investigation form for the import and export of mechanical and electrical products" and technical data, It shall be notified and criticized; if it has obtained the "Standardization Management Record Certificate", it shall be revoked; for the forgery, fraudulent use, alteration, alteration, and transfer of the "Standardization Management Record Certificate", its "Standardization Management Record Certificate" shall be confiscated; Transfer to the judicial authorities for processing.
Article 15 If the administrative department and staff members violate the law and dereliction of duty or seek personal malpractices, the relevant competent department shall impose administrative sanctions; if a crime is constituted, criminal responsibility shall be investigated according to law.
Article 16 These Measures shall be interpreted by the State Bureau of Technical Supervision.
Article 17 These Measures shall be implemented as of May 1998:
