The Regulations on the Administration of Transportation of Dangerous Goods by Road was approved by the 11th Ministerial Conference on June 3, 2005. It is hereby promulgated and will be implemented as of August 1, 2005.

Chapter I General Provisions

The first is to regulate the order of road dangerous goods transportation market, safeguard the safety of people's lives and property, protect the environment, and safeguard the legitimate rights and interests of all parties involved in the transportation of dangerous goods on roads. According to the Regulations of the People's Republic of China on Road Transportation and the Regulations on the Safety Management of Dangerous Chemicals These regulations are formulated in accordance with relevant laws and administrative regulations.
Article 2 Those engaged in the transportation of dangerous goods on roads and the use of self-owned vehicles for the transportation of non-operating road dangerous goods served by the Unit shall comply with these Provisions. Except for military dangerous goods transportation.
Where laws and administrative regulations provide otherwise for the road transport of certain types of dangerous goods, such provisions shall prevail.
Article 3 The term "dangerous goods" as used in these Regulations refers to the characteristics of explosion, flammability, poisoning, corrosion, radioactivity, etc., which are liable to cause personal injury, property damage and environmental pollution during transportation, handling and storage. goods. Dangerous goods shall be included in the National Standard Dangerous Goods Name List (GB12268) and shall not be included in the Dangerous Goods Product Name List, subject to the provisions of relevant laws and administrative regulations or the results promulgated by the relevant departments of the State Council.
The road dangerous goods transport vehicles (hereinafter referred to as special vehicles) referred to in these Provisions refer to trucks engaged in the transportation of dangerous goods on roads.
The term “trunk dangerous goods transport” as used in these Regulations refers to the whole process of transporting dangerous goods through roads using special vehicles.
Article 4 The classification, sub-item, product name and product name of dangerous goods shall be implemented in accordance with the national standard "Dangerous Goods Classification and Product Name Number" (GB6944) and "Dangerous Goods Product Name List" (GB12268). The degree of danger of dangerous goods is classified into Class I, II and III according to the national standard "General Technical Conditions for the Transport of Dangerous Goods" (GB12463).
Article 5 Transport of dangerous goods on roads shall be safe, transported according to law, and be honest and creditworthy.
Article 6 The State encourages large-scale professional dangerous chemical production enterprises with strong technical strength, equipment and transportation conditions to engage in the transportation of dangerous goods on roads, encourage intensive and specialized operations of road dangerous goods transport enterprises, and encourage the use of vans, tanks and Special vehicles such as containers transport dangerous goods.
Article 7 The Ministry of Communications is in charge of the management of dangerous goods transportation in the country.
The competent transportation department of the local people's government at or above the county level shall be responsible for organizing and leading the management of road dangerous goods transportation within its administrative area.
The road transport management agency at or above the county level is responsible for the specific implementation of road dangerous goods transport management.

Chapter II Transportation Permit

Article 8: To apply for the transportation of dangerous goods by road, the following conditions shall be met:
(1) There are special vehicles and equipment that meet the following requirements:
1. More than 5 dedicated vehicles;
2. The technical performance of the special vehicle complies with the requirements of the national standard "Comprehensive Performance Requirements and Inspection Methods for Operating Vehicles" (GB18565). The dimensions, axle load and quality of the vehicle conform to the national standard "Road vehicle dimensions, axle load and quality limits" ( GB1589), the technical level of the vehicle meets the first-level technical level specified in the industry standard "Technical Classification and Assessment Requirements for Operating Vehicles" (JT/T198);
3. Equipped with effective communication tools;
4. There are parking lots that meet safety regulations and are compatible with the scope and scale of operations. Vehicles with special vehicles for transporting highly toxic, explosive and Class I packaging dangerous goods shall also be equipped with special parking areas that are isolated from other equipment, vehicles and personnel, and set up obvious warning signs;
5. Equipped with safety protection, environmental protection and fire protection facilities that are compatible with the nature of the dangerous goods being transported;
6. Transporting highly toxic, explosive, flammable or radioactive dangerous goods shall be provided with tank vehicles or vans, special containers, and vehicles shall be equipped with tachographs or positioning systems;
7. The tank of the tank-type special vehicle shall be inspected and qualified by the quality inspection department. The tank volume of tank-type special vehicles for transporting explosive and highly corrosive dangerous goods shall not exceed 20 cubic meters, and the tank volume of tank-type special vehicles for transporting highly dangerous dangerous goods shall not exceed 10 cubic meters, except for tank containers;
8. For non-tank special vehicles that transport highly toxic, explosive or highly corrosive dangerous goods, the approved load shall not exceed 10 tons.
(2) Employees who meet the following requirements:
1. The driver of the special vehicle obtains the corresponding motor vehicle driving license, and the age is not more than 60 years old;
2. Drivers, loading and unloading management personnel, and escort personnel engaged in the transportation of dangerous goods on roads pass the examinations of the competent transportation department of the municipal people's government in the local district, and obtain the corresponding qualification certificates.
(3) It has a sound safety production management system, including safety production operation procedures, safety production responsibility system, safety production supervision and inspection system, and safety management system for employees, vehicles and equipment.
Article 9 Enterprises and institutions that meet the following conditions may use their own special vehicles to engage in the transportation of non-operating road dangerous goods served by the unit:
(1) One of the following enterprises and institutions:
1. Enterprises that produce, use and store dangerous chemicals approved by the safety production supervision and administration departments at or above the provincial level;
2. Scientific research, military, general aviation and other enterprises and institutions with special needs.
(2) It has the conditions stipulated in Article 8, but the number of own special vehicles may be less than 5.
Article 10 An enterprise applying for the operation of road dangerous goods transportation shall submit an application to the municipal-level road transport management agency in the local district, and submit the following materials:
(1) "Application Form for Road Dangerous Goods Transportation Operation" (see Annex 1);
(2) The types, categories and operating plans of dangerous goods to be transported;
(3) the text of the articles of association;
(4) The identity certificate of the investor and the person in charge and its copy, the identity certificate of the manager and its copy and power of attorney;
(5) Commitment to be invested in vehicles, including the number, type, technical level, communication tooling, total mass, approved load mass, number of axles, and the length, width and height of the vehicle's profile, tanks for tank-type vehicles The volume of the body, the volume of the tank and the quality of the vehicle are matched, and the special vehicle for transporting highly toxic, explosive, flammable or radioactive dangerous goods is equipped with a driving recorder or a positioning system. If the special vehicle to be invested is purchased or existing, a driving license, a vehicle technical grade certificate or a vehicle technical inspection certificate, a tank inspection certificate or a test report and a copy of the tank-type special vehicle shall be provided;
